Nepal Health News, Kathmandu: The Consumer Court has ordered a compensation of NPR 5.07 million after determining that there was negligence in the treatment at Om Hospital located in Chabahil.
The verdict was delivered on Thursday by a bench comprising Chairperson Ram Prasad Sharma and members Gehendra Raj Regmi and Anand Raj Pokharel.
Following the death of 98-year-old Hariprasad Gautam, his son Basanta Gautam had filed a petition demanding compensation of NPR 50 million. The court has ordered the hospital to pay 80% of the compensation — amounting to NPR 4.056 million — while the remaining 20% is to be paid by two doctors, each contributing NPR 305,000.
According to the complaint, Hariprasad was brought to the emergency ward of Om Hospital on Magh 5 (mid-January) after slipping in the bathroom. After a basic check-up and an X-ray, the hospital claimed there was "no major issue," administered a pain relief injection, prescribed some medicines, and discharged him.
However, as the pain did not subside for four days, he was taken to another private hospital, where it was confirmed that his leg had been fractured.
Basanta Gautam filed the case claiming that due to negligence and lack of proper treatment, complications increased, ultimately leading to his father's death. The court found the hospital and the doctors guilty of negligence and ordered them to pay the compensation accordingly.
